The U.S. Department of Labor (DOL) published regulations under the Family Medical and Leave Act (FMLA). These new regulations went into effect on January 16, 2009.
There are a number of revisions to the existing FMLA Regulations and more significantly is the implementation of the active duty and military caregiver leave provisions under FMLA. These new regulations will change family and medical leave in the workplace, particularly the leave for families of individuals in the military. Employers should become familiar with these new regulations.
The Family and Medical Leave Act (FMLA) offers employees up to 12 weeks of unpaid leave when they or a family member suffer from a ‘serious health condition’. Employees must have worked at their company for more than 12 months and also must have worked at least 1,250 hours during the previous year. FMLA guidelines require that companies return employees to their former position with similar pay, benefits and working conditions.
If a company employs fewer than 50 people within 75 miles of the employee’s worksite, the employee does not qualify for FMLA leave.
